" - I Carroll Seeking Court Test : In Detroit Union Controversy DETROIT, Mich"., May 5.— A court test sought by Ray Carroll to protect his union contracts with the Detroit-area race tracks was to be heard this afternoon. The session J was postponed from yesterday by Circuit Judge Thomas F. Maher on request of attorneys for the Building Service Employes International Union AFL . who asked more time to prepare their case. The International ousted Carroll as local head of the 3,500 union members on charges of mishandling 1,000 in union funds. Carroll has asked the court for an injunction barring the race tracks and the International from interfering in the contracts which he claims now belong to his newly formed independent union. The BSEIUwas represented by James Haggerty, Sr. George Fitzgerald, attorney for the Teamsters Union AFL , also was in court yesterday and asked to intervene, stating that he represented about 100 employes involved. Carroll sought court action after the Hazel Harness Raceway announced it would recognize the International as bargaining agent for its employes. The Hazel Park harness meet opens Thursday. Wal I : J ter M. Nelson is serving as counsel for Carroll. Tom Cleary, appointed BSEIU trustee replacing Carroll, stated there would be a meeting of the employes at the Hazel Park track at 8:00 tonight. He added that the locals list of persons available for work at the track would be worked out at that time
