Court Sentences Swartz In Race Fixing1 Case Gets Three Months Definite, Two Months Indefinite, ,000 Fine WELLAND, Ont., June 12. — Harry "Schwabby" Swartz, of Toronto, was sentenced by judge Harold Fuller to three months definite and two months indefinite and fined ,000 or another six months after he pleaded guilty to being a common , cheat in connection with last years race fixing scandal at Fort Erie. ! The charge of conspiracy under the i criminal code was withdrawn by agreement among counsel and his honor. If Swartz had ■ been found guilty of that charge he could have been sentenced to a maximum of seven years. The maximum under the com- . mon cheat charge would have been a two-, year sentence. j Testimony given yesterday included that of Alfred Sharrard, Toronto, former horse owner and trainer, who testified that following an agreement reached with John Perron he agreed to have his jockey pull Hemjohn, the favorite, in the race on July j 25, won by North Drive. The arrangement was that he was to get 00 and have a . 00 bet placed on the winner. j Inspector Charles Wood testified that I every effort made by Ontario Provincial Police to apprehend Perron had been futile. Phillip Marchese, one of the jockeys suspended as the result of race scandal, testified he had accepted 00 to pull a horse on July 14, and an additional 00 to "look after" another horse ridden by Bobby At-kin, who refused to take a bribe. He also testified that he had refused to accept a bribe on two occasions when he thought he had a winning horse. The Crown closed its case with the reading of the transcript of testimony given by Robert Wankmueller, at the preliminary hearing. Wankmueller is now in the U. S. Army. In cross examination by E. J. Murphy, associate defense counsel, George Thompson and Phillip Marchese both admitted they had given perjured testimoney when they first appeared before the Ontario Racing Commission.
