Winn, former president of Churchill Downs, yesterday asked Circuit Court to decide a con-I test over a section of his will. The section in question dejils with the method of pay-j ing estate andother taxes plus various ex-i penses connected with administration of the estate. Winn willed his American Turf Associa-; tion stock worth 77,000 and representing half of his estate to three of his four living daughters, Miss Clara Winn and Mrs. Helen Kirschberg, both of New York, and Mrs. Louis J. Hermann, Louisville. A suit brought by Winns eldest daughter, Mrs. Ann Winn Ellwanger, Chicago, against Mrs. Hermann and her husband was dis-i missed in Circuit Court in January. Mrs. Ellwanger alleged the Hermanns unduly influenced Winn when he did not include Mrs. Ellwanger in distribution of the turf stock which, later, was converted to Churchill Downs stock. Mrs. Ellwangers attorney said at the time he planned an appeal but, yesterday, he said no appeal had been made so far.
