Issues Restraining Order On Copyright Infringment KSAN Enjoined From Using Daily Racing Form Charts in Broadcast SAN FRANCISCO, Calif., May 4.— Federal judge O. D. Hamlin yesterday afternoon granted Triangle Publications, Inc., a restraining order enjoining radio station KSAN from infringing the copyrights of the plaintiff by using the plaintiffs racing charts in broadcasting. Attorneys Moses Lasky and J. D. Bar-num, Jr. represented the publishing concern. Golden Gate Broadcasting Corporation, operators of KSAN, its manager, Richard Bott, and its announcer, Herb Markell, were the persons restrained. Judge Hamlin, sitting in Federal District Court, set Friday of this week as the date on which the defendants may appear to show cause why the temporary in-V junction should not be made permanent. The case grew out of KSANs unauthorized use of Triangle Publications, Inc. Daily Racing Form result charts of the Golden Gate Fields races. The radio station was recreating the races off the Daily Racing Form charts on a daily pro- gram which started at 6:15 p.m., with announcer Herb Markell doing the broadcasting. t KSANs race program is allegedly sponsored by an organization which sells tips on the races. In other words, a "touting" outfit.
