I KURTSINGER OUT OF TfflT KENTUCKY DERBY -4 LOUISVILLE, Ky., April 19. It became apparent here today that Charles Kurt-singer, Louisville jockey, who has ridden two previous winners of the Kentucky Derby, would not be able to ride in this years running of the stake unless his employer, the Brookmeade Stable, lifts its suspension of the rider for disregarding instructions. Confirmation of Kurtsingers suspension was received at Churchill Downs today from the New York racing commission. According to C. Bruce Head, one of the Churchill Downs stewards, the New York turf body ruled that the action of Kurt-singers employer would stand until it is lifted by the stable. The suspension will be recognized in Kentucky. Kurtsinger was suspended for an alleged violation of instructions issued by Hugh Fontaine, trainer of the Brookmeade Stable, which is maintained by Mrs. Isabel Dodge Sloane. The rider is said to have ignored Fontaines order to remain in New York by leaving, for Kentucky to ride H. P. Head-leys Menow at Keeneland last Friday. Kurt-I singer was to have had the mount on Menow in the Derby on May 7.
