NEGROES WIN NEW TRJAL WASHINGTON, D. C, April 2. Clarence Norris and Haywood Patterson, negroes who were convicted of having attacked a white woman near Scottsboro, Ala., back in 1931, had their death sentences set aside by the United States Supreme Court and were ordered to face trial again. The convicted pair contended that they had been deprived of their constitutional rights because they were indicted by a grand jury and convicted by a trial jury in which members of their own race were excluded. In his opinion Chief Justice Hughes stated that there was evidence that qualified negroes were available for jury service. He further asserted that it was the duty of the trial court to quash the indictments when they saw that negroes were absent from the jury rolls.
