Superior Court Promises Fiske Decision by July 1 LOS ANGELES, Calif., June 24.— A decision by July 1 on the writ of mandate filed several weeks ago by Alfred B. Fiske, former secretary of the California Horse Racing Board, who was ordered removed from his post by the state personnel board, has been promised by Judge Malcolm C. Glenn of the superior court at Sacramento. Fiske originally had filed an exception with the personnel board stating that the charges of the racing board that he had been insubordinate and discourteous "to John H. Sattler, a board member, were unjustified and not sufficient grounds to merit dismissal. When his petition was rejected, Fiske then turned to the superior court petitioning for a writ of mandate ordering the personnel board to conduct a hearing on the merits of the dismissal charges. Paul Joseph, deputy attorney general, replied to the arguments of Fiske s attorney, James Phillips, by stating that the superior court was not proper at this time as the case still remains under the jurisdiction of the state personnel board.
