4 Suit Against W. L. Jones, Jr. , As Breeder of Royal Bay Gem CHURCHILL DOWNS, Louisville, Ky., May 2. — Michael J. Hogan, tavern operator of this city, contended in a circuit court suit here that he is the breeder of Eugene Constantin, Jr.s, Royal Bay Gem. The de- —-fendant in the suit is Warner L. Jones, Jr., , owner of Hermitage Farm, Goshen, Ky., where Royal Gem II., sire of the three -year-old in question, stands. Hogan claims 50,000 damage because Jones "dishonestly" registered himself as breeder. 4 Hogan claims that he owned Bayadere, dam of Royal Bay Gem at the time of foaling and subsequently sold dam and foal to Jones for ,000. He contended this sale did not include the breeders property N rights. The breeders share of the Kentucky , Derby purse is ,000 for the winner, ,000 second and 00 third. Jones denies that Hogan is the breeder. His attorney, Royden Peabody, Jr., said: "The rules of the New York Jockey Club * say that the breeder of a foal is the owner of the mare at the time the foal is born. .
