SUPREME COURT RULING WASHINGTON, D. C, May 22.— The Supreme Court, again upsetting precedent, today ruled that salaries of Federal judges taking office after June 6, 1932, are subject to federal income tax. Decision was rendered on the governments appeal in its effort to tax the 2,500 salary of Circuit Court Judge Joseph W. Woodrough, of Omaha. Justice Frankfurter read the decision which indirectly rejected a nineteen-year-old ruling of the high court on the question of constitutionality of taxation of judges. The high court previously had ruled that a Federal judge could not be taxed because the Constitution prevents Congress from diminishing his salary while in office. In the case of Judge Woodrough, he was promoted from Federal District judge to a ; judge of the Circuit Court.
