Question of Constitutionality On Jersey Night Harness Bill TRENTON, N. J., May 26. — The question of , the constitutionality of a bill passed Monday by the New Jersey State Senate legalizing night harness racing has been raised by Gov. Robert B. Meyner. The Governor yesterday cited a passage in the state constitution that prohibits gambling without a referendum. He said that pari-mutuel betting at tracks now is limited to the period between sunrise and sunset as approved in a 1939 referendum, indicating another public vote would be required to put the measure, if it finally becomes law, into effect. The Governor added he has not yet decided whether he favors night harness racing, but would consult with the state racing commission to determine if "the high standards prevailing at tracks in this state" would be affected. He said he would urge the State Assembly, which has yet to action the bill, to consider its constitutionality before taking a vote.
