FOB SALE PUBLIC AUCTION Wheeling Downs THE MOST BEAUTIFUL HALF-MILE , TRACK IN THE NATION The undersigned Federal Receiver will offer for sale -at public auction ON THE PREMISES of the WHEELING DOWNS RACE TRACK, Wheeling, West Virginia, on WEDNESDAY, JUNE 12, 1957, at 2:00 P. M., EDST, all of the property owned by Wheeling Downs, Inc. generally known as "Wheeling Downs", EXCLUDING cash, securities, accounts receivable, deposit money due from the American Totalisator Co., and the unexpired value of insurance policies. INCLUDED IN THIS SALE: About 113 acres of ground, with all the improvements thereon. All supplies, modern automotive equipment, other equipment and personal property owned by and used in tfie operation and maintenance of, Wheeling Downs. Modern, sanitary barns stable 725 horses. Senior-type "Tote" board. Average annual mutuel handle, last four years: oyer 2 million. TERMS OF SALE: 1 Highest bidder on date of sale must tender certified check in amount of 00,000.00, payable to the undersigned Receiver. 2 Sale not final until confirmed by the U. S. District Court for the Northern District of West Virginia. 3 The prospective owners and operators must meet with the approval of the State Racing Commission under the laws of the State of West Virginia. 4 BALANCE of purchase price, IN CASH, must I be tendered at the time of and simultaneously with, Court confirmation. 5 Certified check to be returned to the bidder upon refusal of the State Racing Commission to approve, or the refusal of the Court to confirm; otherwise to be applied toward the purchase price, or be retained by the Receiver as liquidated damages. 6 Purchaser must assume liability for payment of 1957 State and local property taxes. 7 The Receiver reserves the right to reject any bid or bids. 8 The sale may be kept open and continued from time to time. s CARL O.
